Rule of Law and Civil Procedure Code, 1908: A Check for Conformity

The expression rule of Law is major foundation and bedrock of democracy on which almost all state across the globe is constituted. The term rule of Law means the sovereignty or ascendency of Law. Thus, it can be said that there will be Rule of Law in a state if the Law of that state is sovereign or supreme above all other things and entities within a state. In this paper, the definition of Rule of Law is first delved into, and an attempt is made to define the same from various slants. Proper attention is paid to the questions like what is the nature of the Rule of Law. What are the indispensable principles, which regulate the notion of Rule of Law? Besides that, the rationale of the Rule of Law is brought under discussion. Chronological development of the concept is also discussed at some length. Eventually, an attempt is made to look at the code of civil procedure, 1908, in light of the Rule of Law concept. A kind of terse analysis of the aforementioned code is made to determine whether it is in harmony with the concept we are dealing with or not. Moreover, some recommendations are made to bring Civil Procedure Code (C.P.C.) 1908 under the concept of Rule of Law.
